1. Acceptance of Terms

Welcome to "Fall in Love with Gaming" (the "Campaign"). By accessing this platform, applying as a streamer, or enrolling as a sponsor, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use this platform or participate in the Campaign.

These Terms constitute a legally binding agreement between you ("Participant," "Streamer," "Sponsor," or "User") and Chroma Mystic ("Organizer," "we," "us," or "our").

2. Campaign Overview

The "Fall in Love with Gaming" Campaign is a 3-month multi-platform livestreaming and content creation initiative running from September to November 2026. The Campaign connects streamers with sponsors to create engaging gaming content, foster community, and celebrate cozy gaming culture.

Participation in the Campaign is subject to approval by the Organizer. We reserve the right to accept or reject any application at our sole discretion.

3. Streamer Participation

3.1 Eligibility

To participate as a streamer, you must:

• Be at least 18 years of age (or have parental/guardian consent)
• Have an active presence on at least one streaming or social media platform
• Provide accurate and complete information in your application
• Agree to follow Campaign guidelines and deliverable requirements

3.2 Streamer Obligations

As a Campaign streamer, you agree to:

• Maintain a consistent streaming schedule aligned with Campaign goals
• Create original, high-quality content that reflects positively on the Campaign and sponsors
• Foster a positive, inclusive, and non-toxic community environment
• Comply with all platform-specific terms of service (Twitch, YouTube, TikTok, etc.)
• Disclose sponsorships and sponsored content in accordance with FTC guidelines
• Submit required deliverables (streams, clips, posts, mentions) by specified deadlines
• Participate in Campaign check-ins and provide performance metrics when requested
• Not engage in hate speech, harassment, discrimination, or any conduct that violates community standards

3.3 Streamer Compensation

Streamer compensation is based on the tier and terms agreed upon with matched sponsors. Compensation may include revenue share, flat fees, bonuses, or other arrangements as specified in individual sponsor agreements. Payment is subject to successful completion of deliverables and verification by the Organizer.

4. Sponsor Participation

4.1 Eligibility

To participate as a sponsor, you must:

• Represent a legitimate business or brand
• Provide accurate company and contact information
• Select a sponsorship tier and fulfill associated financial obligations
• Agree to follow Campaign brand guidelines and partnership standards

4.2 Sponsor Obligations

As a Campaign sponsor, you agree to:

• Pay the agreed sponsorship fees by the specified deadlines
• Provide brand assets (logos, guidelines, briefs) in a timely manner
• Collaborate respectfully with assigned streamers
• Not require streamers to create content that violates platform policies or community standards
• Comply with all applicable advertising and disclosure regulations
• Provide feedback and verification for streamer deliverables as requested

4.3 Sponsor Benefits

Sponsor benefits vary by tier (Bronze, Silver, Gold, Platinum) and may include streamer integrations, brand mentions, logo placement, audience reach reports, and other deliverables as specified in the tier descriptions. Specific assignments and deliverables will be coordinated by the Organizer.

5. Intellectual Property

Content ownership:

• Streamer Content: Streamers retain ownership of their original content. By participating, streamers grant the Organizer and sponsors a non-exclusive, royalty-free license to use, display, and promote such content for Campaign-related purposes.
• Sponsor Materials: Sponsors retain ownership of their brand assets, logos, and proprietary materials. Sponsors grant the Organizer and streamers a limited license to use such materials solely for Campaign deliverables.
• Campaign Branding: All Campaign branding, logos, and materials are owned by Chroma Mystic and may not be used without explicit permission.

6. Code of Conduct

All Participants agree to:

• Treat other Participants, organizers, and community members with respect
• Not engage in harassment, bullying, discrimination, or hate speech
• Not promote illegal activities, violence, or harmful behavior
• Not impersonate others or provide false information
• Not spam, scam, or engage in fraudulent activities
• Not disrupt Campaign activities or undermine the experience of others

Violation of this Code of Conduct may result in immediate removal from the Campaign without refund or compensation.

7. Privacy and Data

Your use of the platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By participating in the Campaign, you consent to the data practices described in the Privacy Policy.

8. Disclaimers and Limitation of Liability

Platform and Campaign are provided "as is" without warranties:

• We do not guarantee specific viewership, engagement, or earnings outcomes
• We do not guarantee successful sponsor-streamer matches
• We are not responsible for technical issues, platform outages, or third-party service disruptions
• We do not endorse or guarantee the quality of sponsor products or streamer content

Limitation of liability:

To the maximum extent permitted by law, Chroma Mystic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your participation in the Campaign or use of the platform.

9. Termination

We reserve the right to suspend or terminate your participation in the Campaign at any time, with or without cause, for violation of these Terms, disruptive behavior, or any reason deemed necessary by the Organizer. Upon termination, you may forfeit unpaid compensation or sponsorship benefits, depending on the circumstances.

10. Modifications to Campaign

We reserve the right to modify, suspend, or cancel the Campaign or any aspect of it (including deliverables, timelines, or benefits) at our sole discretion. We will provide reasonable notice of material changes when feasible.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Campaign shall be resolved in the appropriate courts of the jurisdiction where Chroma Mystic is based.
